PRIVATE LANDING STRIP: DISCLAIMER & INDEMNITY
In this indemnity, “the Company” shall mean BISHOPS COVE FARM (PTY) LTD, its respective
directors, shareholders and employees (all of whom shall hereinafter be referred to as the Company).

 I, the undersigned ……………………………………. hereby declare that I have been warned
and made aware of the potential risks, dangers and threats attendant upon the use of this
private landing strip and hereby agree to waive and abandon all rights of action against
the Company, in accordance with the terms and conditions hereof.

 I do therefore on my own behalf and on behalf of my dependants, minor children, heirs,
executors, trustees, successors and assigns hereby agree to indemnify and hold harmless
the Company, against any claim of whatsoever nature and howsoever arising, including,
but without limitation, for or on account of, or arising from, or in any way connected with
injury to, or death of, any person including myself, or loss or damage to any property
(each “a claim”) which may at any time be suffered or incurred, whether directly or
indirectly, as a result of, or in any way connected with or attributable to the use of the
landing strip by me, whether or not such injury, death, damage or destruction, is
occasioned by or resulting from the fault or negligence of the Company (including gross
negligence) or breach of contract by the Company.

 In addition the Company shall not under any circumstances whatsoever, whether due to
any breach of contract and/or wrongful and/or negligent (including grossly negligent)
acts or omissions, incur or have any liability for any special or consequential damages or
losses of whatsoever nature and howsoever caused whether direct, indirect or
consequential, including but not limited to loss of income, loss of profit and increased
cost of working.

I furthermore acknowledge and agree that the use of all and any facilities and/or
property belonging to, or under the control of the Company, including but not limited to
parking facilities, aircraft hangers and/or offices is done so entirely at my own risk and
I hereby indemnify and hold harmless the Company against any claim.

 The Company shall not bound by any representation, indulgence, waiver or modification
in respect of the abovementioned terms and conditions by its employees, servants,
agents, directors, officers or invitees, unless reduced to writing and signed by a duly
authorized representative of the Company.
